General Terms and Conditions (AGB)
Conditions of participation for our guided road bike and MTB tours

    1.     anyone can participate who is healthy, has a good physical condition and cycling experience, is up to the conditions mentioned in the tour description (technical and physical) and brings the appropriate
              equipment  (bike, suitable cycling clothing, closed shoes, helmet), or who has reserved and borrowed them from us in advance. The leader of the group (guide) is entitled, at the beginning or during the tour, to
              completely or partially exclude a participant who, in his opinion, does not meet these requirements from the tour program. In this case there is no right to a refund of the tour price. In the case of driving
              technique training, the trainer decides whether and to what extent target and desired exercises will be achieved and carried out. The safety of the participants and the group is in the foreground.
        2.   helmets must be worn during all tours. In principle, each participant rides at his own risk and is aware of the dangers that arise in the terrain and through the use of a bicycle/mountain bike.
        3.   each participant practices the bike sport on Fuerteventura at his own risk. Deep Blue Cycling assumes no liability for accidents and physical damage resulting from the practice of the sport on     
              Fuerteventura.
        4.   the participants are responsible for the observance of the road traffic regulations on Fuerteventura.
        5.   no liability is assumed for minors. In addition, the power of attorney of the legal guardian is absolutely necessary for the entire participation. All participants must have reached the age of 16 at the start of the
              tour.
        6.   the participants will not hear any music (through headphones, etc.) during the tour.
        7.   it is forbidden to drive freehand during the tour.
        8.   the participants must keep sufficient distance to other participants and the guide.
        9.   By registering for our tours, the participant agrees that the guides take photos during the tour and publish them afterwards (flyer, website, Instagram, Strava etc.).
        10.  there is a strict ban on alcohol during the tours.
        11.  the guide always drives up, unless he/she gives clear instructions where to wait.
        12.  the tour participants agree not to go beyond their means and responsibility.
        13.  costs for damages to the rented bike, e.g. but not exclusively due to fall, carelessness, wrong leaning, falling over etc., will be covered by the participant - the bikes are NOT insured. The maximum sum of
these costs is the new price of the rented bike. For unintentional damages an extension of the personal liability insurance can be concluded, which must be concluded by the participant before holiday start. You are welcome to ask us for more information.
        There is no claim for damages against Deep Blue Cycling. Should the booked tour be cancelled, there is a maximum claim for the compensation of the tour price.
        When filling in the disclaimer before the tour starts, the participant informs the guide whether he needs medication or has relevant illnesses or injuries.

    Rental conditions

THE WHEELS ARE NOT INSURED OUTSIDE OUR SHOP, not even on the tours.
Unless there was a chargeable insurance, before the handover was concluded
When concluding the contract, the tenant must present a valid identification document (with current place of residence) (no credit cards, driving licences, etc!) and a deposit of 50€ per hardtail, 100€ per fully, fat or carbon bike.
The rental price and the deposit must be paid in advance. In the event of premature termination of the rental period due to illness, weather, unwillingness, etc., the price will not be refunded.
The bike must ALWAYS be secured with at least one lock when parked by the renter and kept overnight in a locked room and still be secured with a lock.
In case of theft or loss of the bike the renter is liable!
In the event of loss or damage of the accessories provided free of charge, the renter is liable to the amount of:
Saddlebag 15€,
Hose 5€,
Lock/key 25€,
Tyre lever 3€,
Pump 20€,
Helmet 50€,
Repair kit 3€,
Speedometer or GPS computer depending on model 50-150€
The tenant is liable for any damage caused by this. For damages caused unintentionally by the tenant an extension of the personal liability insurance can be concluded, which must be locked by the tenant before vacation beginning. You are welcome to ask us for more information.
The daily rent is from morning at the earliest 9 o'clock to evening max. 17 o'clock. (depending on seasonal opening hours). We do not grant staggering or half-day prices. If the tenant wants to pick up or drop off the bike outside the seasonal opening hours, a service fee of 10€ per appointment will be charged.
The bike is provided by us in perfect condition and must be returned in the same condition. The renter undertakes to handle the bike with care, to load it with a maximum of 105 kg and to keep it away from seawater and sand in particular. Only the mountain bikes may be ridden in the sand but must NOT be brought into contact with sea water. The renter undertakes to observe the maximum extension length of the seat post and not to exceed this limit: the renter is liable for frame breakage caused by this. The renter is liable for any damage to the bike during the rental period. The amount of the damage is determined by Deep Blue Cycling: it corresponds to the replacement price of the damaged parts/frame/bike.
Should the bike not be in a rideable condition during the rental period, Deep Blue Cycling is not entitled to immediate replacement or repair. For repairs in external repair shops we ONLY pay after prior arrangement (Of course we give our best, in order to get the rented bike immediately again ready to ride). Should the rented bike not be ready to ride before signing the rental contract, so that the rental relationship does not come about, Deep Blue Cycling will refund the complete rental price paid in advance to the renter/booker. Further claims of the renter (in particular claims for replacement, loss of holiday enjoyment, etc.) do not exist.
If the bicycle is not returned on the evening of the end of the rental contract before the end of the opening hours or at the agreed time, a further complete daily rental price will be due. Our reduced long-term rental prices are only granted if the rental period is continuous.
Travel and contract conditions, general terms and conditions for tour and bike bookings (AGB)
1. With your personal, telephone, written or electronic registration (e.g. email/booking form) for one or more tours or with your booking/reservation of one or more rental bikes you offer Deep Blue Cycling the conclusion of a binding contract. The contract is concluded with the receipt of the booking confirmation (declaration of acceptance) by Deep Blue Cycling. It does not require a specific form. From this time on, the rights and obligations arising from the contract are binding for you and all other participants registered by you. We expressly point out the validity of our general terms and conditions as well as the tour and travel conditions. They apply to all participants named in the registration.
2. Upon receipt of our booking confirmation by you, a deposit of at least 50% of the amount stated on the booking confirmation is due for all travel/tour/rental bookings within approx. 14 days. You will find the exact amount of the deposit in the booking confirmation sent to you by e-mail.
The exact payment dates can be found in the booking confirmation sent to you by e-mail. In case of late payment Deep Blue Cycling reserves the right to cancel the booking, the places on the tours and/or the booked bike reservations, the places on the tours or the booked private guide.
4. cancellation conditions You can change, rebook, cancel or prematurely cancel your booked individual service (tour/bike rental/training/camp) with Deep Blue Cycling at any time. You will be charged the following cancellation fees:
Costs per person as a percentage of the total booking price: as of booking date

up to the 30th day before the start 20 %. 

from the 29th to the 22nd day before the start 25%.
 
from the 21st to the 15th day before the start 35%.
 
from the 14th to the 08th day before the start 50%.
 
from 07. to 02. day before the start 80 %.
In the event of later cancellation, non-arrival or premature termination, the total booking costs, i.e. 100% of the tour and/or rental price will be charged.
